SHC notice on petitions filed by Karachi residents

KARACHI (PPI): Sindh High Court Friday issued notice to Deputy Attorney General and other respondents on petitions filed by residents of Shah Latif Town, Karachi for legal electricity connection and installation of meters.
SHC Division Bench comprising Chief Justice Mushir Alam and Justice Aftab Ahmed Gorar order said: "Urgency application is granted. Exemption is granted subject to all just exceptions.
This application is also exemption application which is granted subject to all just exceptions.
It is, inter alia, contended that petitioners are consumers of electricity through Kunda. Now it appears that KESC has introduced franchise to recover electricity dues from residents who are consuming electricity through Kunda and amount to be realized by these franchise holders or sub-directorate from such localities, is causing concerns to petitioner. Petitioners claim that they are prepared to avail regular supply of electricity through installation of meters.
"Umar Hayat Sindhu counsel for Respondent number 4 to obtain instructions as to manner in which supply of electricity could be regularized in favour of petitioners.
Umar Sindhu also pointed out that some of residents have already filed a suit 166/2012 pending in court of Ist Senior Civil Judge, Malir, which is also fixed today.
This fact is disputed by learned counsel for petitioner. According to him, petitioners are not the parties to suit. Whatever the case may be, let counter rejoinder be exchanged before next date.
Notice be issued to respondent number 1&2 as well as DAG.
Respondent number 4 may not resort to any unauthorized manner to recover electricity dues, it at all, it is to be recovered from locality prorata to be worked out and provisional bills may be issued to consumers for recovery of amount."
The 30 petitioners residents of sector 16-A Shah Latif Town, Malir submitted they approached KESC to provide electricity and are ready and willing to pay all legal charges but KESC and its officers through local so called contractor extracted money from them twice and yet did not gave connections.
They prayed to direct KESC provide them connections on legal payment.
