SHC directs investigation into police torture

KARACHI (PPI): Sindh High Court (SHC) Tuesday directed Ali Sher Jakhrani, AIG (Legal) Sindh to conduct an enquiry into the matter of allegations of maltreatment on one Peeral, a detenue, at the hands of the SHO Police Station Khairpur Nathan Shah, Taluka Khairpur Nathan Shah, district Dadu Sindh.
SHC divisional bench comprising Justice Munib Akhtar and Justice Aftab Ahmed Gorar in its order said: 'We have seen the report filed by learned DJ Dadu and first of all we would like to record our appreciation on the promptness with which the learned DJ as well as the concerned Magistrate have compiled with the order of the court. From the report it appears that the detenue Peeral was, in fact, shown as having been arrested on the very date that the learned Commissioner visited the police station and he has been shown as having been arrested at 12.00 noon in Crime no. 107/2012. The learned Magistrate has reported that there were signs of maltreatment on Peeral and, therefore in compliance of the order of the High Court he has been shifted to Civil Hospital Dadu where he is under treatment.
In view of the report that has been placed before that court, let this matter come up on August 09, 2012, till that date Peeral shall remain at Civil Hospital Dadu, though since now he has been shown as having been arrested in the aforesaid FIR he should remain under the police custody, however the police authorities are directed to ensure that the family of Peeral shall have at all times immediate access to him.
On instruction, learned counsel for the petitioner states that the maltreatment that has been suffered by Peeral has been at the hands of SHO PS KN Shah namely Ghulam Sarwar Zardari and respondent number 4 viz. ASI Muzaffar who is present before the court today. On the next date before these officers must be present before the court. In case any of them is absent on account of any reason or excuse whatsoever including but not limited to excuse by way of official duty, the same shall not be entertained and action shall be taken against the absent officer for being disobedient of the court orders.
Subject to such orders as may further be made in this matter Mr. Ali Sher Jakhrani, AIG (Legal) is directed to conduct an enquiry into the matter of allegations of maltreatment on Peeral at the hands of the SHO and the police officer present today and any other police officer who may be found responsible in this regard Mr. Jakhrani may call for a medical report from the Civil Hospital Dadu. The report should be submitted within ten days before the court. Further action shall be taken in the light of the findings on the basis of the enquiry. Copy of this order may be sent to Mr. Jakhrani in order to ensure compliance.
